Fair Lending Policy

Effective Date: 25th September, 2024

Purpose

This policy outlines Ameritrust Mortgage Corporation's ("Ameritrust") commitment to fair lending practices and its dedication to ensuring that all applicants and borrowers are treated fairly and equally, without regard to any prohibited basis of discrimination. Ameritrust adheres to all applicable federal and state fair lending laws, including but not limited to the Equal Credit Opportunity Act (ECOA) and the Fair Housing Act.

Prohibited Bases of Discrimination

Ameritrust will not discriminate against any applicant or borrower on the basis of:

  • Color

  • Religion

  • National origin

  • Sex

  • Marital status

  • Age (provided the applicant has the capacity to enter into a binding contract)

  • Receipt of income from a public assistance program

  • The good faith exercise of any right under the Consumer Credit Protection Act

Fair Lending Practices

  • Objective Criteria:

    All loan applications will be evaluated based on objective criteria related to creditworthiness, including income, assets, debt obligations, and credit history.

  • Consistent Underwriting:

    Ameritrust will apply consistent underwriting standards and criteria to all applicants, regardless of any prohibited basis.

  • Pricing and Terms:

    Loan pricing and terms will be determined based on objective risk factors and will not vary based on any prohibited basis.

  • Marketing and Outreach:

    Marketing and outreach efforts will be conducted in a manner that is inclusive and does not discourage or exclude any group of potential borrowers.

  • Employee Training:

    All employees involved in the loan origination and underwriting process will receive regular training on fair lending laws and Ameritrust's fair lending policies and procedures.

  • Monitoring and Reporting:

    Ameritrust will monitor its lending activities to identify and address any potential disparities or discriminatory practices.

Complaint Resolution

Ameritrust has a dedicated process in place for addressing any complaints or concerns regarding potential discrimination or unfair lending practices. Any individual who believes they have been discriminated against may file a complaint with Ameritrust's Compliance Department or with the appropriate regulatory agencies.

Consequences of Non-Compliance

Any employee found to have engaged in discriminatory lending practices will be subject to disciplinary action, up to and including termination of employment.
